It should be new. Second, ventilation: ridge vent has to be paired with adequate soffit intake or it does nothing, and an attic that cannot exhaust humid summer air will cook the underside of a brand new roof.

Tear-off, not layover

New Jersey code permits roofing over one existing layer in many situations, and some contractors will offer it as a cost saving. We do not do it. Roofing over hides rotted decking you are then paying to ignore, adds weight the framing was not designed for, voids most manufacturer warranties, and makes the next replacement more expensive than the savings you just captured. Tearing off to bare wood is also the only way anyone can honestly tell you what condition your deck is in.
